Loophole or no, this is the way the curse has worked since it was introduced. When it was first used against me, I didn't like that fact either, but in the times I need to plan an attack, I wouldn't want it the other way - you never know when any merchant might want to dust off his battleships (or actually build some) and take care of business with cannon.
